Liability Waiver.
Please read the following in its entirety.
1. Assumption of Risk. The undersigned (hereinafter, "the Runner") acknowledges that participation in The Jams Marathon (hereinafter, "the Race") involves inherent risks of physical injury, including but not limited to muscle strain, joint damage, dehydration, hypothermia, hyperthermia, blister formation, lost toenails, sudden onset of doubt, and contact with insects, wildlife, or members of the public. The Runner voluntarily assumes all such risks in their entirety.
2. Release of Claims. The Runner hereby releases, waives, discharges, and covenants not to sue The Cedar Valley Marathon Authority, the Race Committee, individual Committee members, and the proprietors of any establishment along the course, for any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or inconvenience sustained by the Runner during or as a result of participation in the Race.
3. Medical Authorization. The Runner authorizes the Race Committee and its designated agents, in the event of an emergency, to procure medical treatment on the Runner's behalf, including but not limited to the administration of water, the application of bandages, and the calling of telephone numbers provided in the Runner's emergency contact information.
4. Photo and Likeness Release. The Runner grants The Cedar Valley Marathon Authority a perpetual, royalty-free, worldwide license to reproduce the Runner's name, likeness, and finishing time in all official Race materials, including but not limited to results pages, finisher montages, and the Race's annual Yearbook (production of which has not yet commenced).
5. Weather Acknowledgment. The Runner acknowledges that the Race will be contested under whatever weather conditions prevail on race day, including precipitation, wind, fog, and conditions that the National Weather Service has not yet classified. The Race Committee reserves the right to delay, modify, or terminate the Race at its discretion, and the Runner agrees that no refund of the entry fee shall be owed under any such circumstance.
6. Conduct. The Runner agrees to comply with all Official Course Rules, to treat fellow runners, volunteers, spectators, and the proprietors of any establishment along the course with courtesy, and to refrain from depositing trash on the Cedar Valley Nature Trail. The Runner further agrees that the consumption of coffee during the race, while permitted, shall be conducted in a manner that does not endanger the Runner or others.
